| MOFFAT COUNTY LAND USE BOARD MEETING MINUTES FEBRUARY 13, 2006 Attendees: Jean Stetson, LUB Richard Blakley, LUB Jeff Comstock, Moffat County Brad Petch, LUB Lane Osborn, LUB Tom Gray, Moffat County Dave Watson, LUB Linda Watson, citizen Ed Winters, LUB Steve Tegtman, LUB Doug Wellman, LUB Vicki Burns, LUB Bob Grubb, LUB T. Wright Dickenson, LUB Steve Hinkemeyer, LUB CJ Mucklow, CSU Extension Service Mike Camblin, LUB Tom Deakins, LUB Call to Order Richard Blakley called the meeting to order at 7:05 pm. Roll call was taken. Moment of Silence Approval of Minutes from January Vicki Burns made a motion to accept the minutes as written. T Wright Dickenson Seconded. The motion passed unanimously. General Discussion Easements Presentation CJ Mucklow, CSU Extension Service The talk was all about conservation easements. See slide show attached to the minutes for more details. The slides detail a good deal of the discussion and most of the questions surrounding the presentation had to do clarifying how can easements by modified after they are formed. There was discussion concerning condemnation of an easement and modifying because the values that are protected no longer exist. There was a lot of discussion concerning easements for a period of time, usually ten years or longer. Those types of easements are not being recognized by the Internal Revenue Service as qualifying for tax benefits. Attach slide show presentation Conservation Easements : What They Are and Are Not CWCB In-stream Flow Update Jeff Comstock, Moffat County Based upon recommendations of the LUB, the Moffat County Commissioners sent the letter dated December 9, 2005 to the Colorado Water Conservation Board. The letter opposed in-stream flow designation for Little Cottonwood Creek and Beaver Creek, in Moffat County. There will be a CWCB In-stream Flow Workshop on February 21, 2006. Public comment is invited. Jeff is looking for some input on where the board wants to go from here on Little Cottonwood Creek and Beaver Creek, which are the two still under consideration for 2006. The North and South Forks of Fortification Creek have been deferred to 2007 for now. Jeff is planning to attend the meeting in February. Jeff is looking for people who can testify to whether waters flow year round or not, or why in-stream flows are not required to protect water rights. Sage Grouse Plan Update Brad Petch, CDOW The LUB letter showing concern for the completion of the Sage Grouse Plan has put the priority of finishing the plan higher on the list of things to complete. Hopefully within the next several weeks there will be a final draft. The statewide plan is gathering steam and will probably begin working with the local plans beginning in May 9-12, 2006. The hope would be to have four or five people from the local working groups to attend the meeting. The meeting will be in Steamboat. Once the plan is underway, they may ask for one person from each of the five working groups to sit on a steering committee throughout the remainder of the process. The statewide plan will be a bottom up plan so that local plans will not be trumped. The plan should address anything the local plans miss and should address more than the local populations but look at regional effects as well. The Colombian Sharp Tail Grouse have been listed again. The USFWS has been sued due to lack of progress on the listing petition. In Moffat County are doing well locally and in Colorado, but are not doing well in other States here in the west. Brad hopes to have a draft by February 27th or 28th of this year. Election of Officers Chairman, Vice Chairman and Secretary/Treasurer Vicki Burns made a motion to keep the same slate of officers for 2006 that have served the last several years. Richard Blakley, President, Tom Deakins, Vice President and Steve Hinkemeyer, Secretary/Treasurer. Bob Grubb seconded the motion. The motion passed unanimously.
