Call to Order:

Vice Chairman Richard Blakely called the meeting to order at 7:05 pm
Roll call was taken.
Richard turned Meeting Over to Chairman Ed Winters at 7:10 pm

General Discussion/Committee Reports


Archaeology:

The LUB discussed the BLM MOU on Section 106 reviews. The MOU has been setting on the State BLM Archaeologists desk for several months with no progress. The LUB noted that they felt like the County was being pigeon holed and that there may be a need talk to the State Director regarding furthering the agreement.

BLM was invited to attend this meeting to discuss a Sand Wash Basin arch grant. BLM had informed Jeff and Tom that they would not be able to attend this Land Use Board Meeting due to previous engagements. Jeff spoke with Robyn Morris and invited her to present the Sand Wash grant to the LUB and she was unable to attend the meeting also. The LUB discussed that due to timeframes of BLM wanting to submit the grant prior to April 1st that the LUB would be willing to call as special meeting between now and April 1st (grant deadline) to discuss the grant. Audrey Danner informed Jeff that BLM had requested a letter of support from the City of Craig and the Moffat County Tourism Assn for the Sand Wash Grant. Jean commented that it felt like the LUB was being deliberately ignored on this issue. Ed suggested the LUB invite BLM to a special meeting held at their choice to review the Sand Wash grant since the LUB was the primary board advising the County Commissioners on archaeology issues. Jean suggested the invitation be in writing and also suggested that if the LUB holds a special meeting to invite permittees, wild horse representatives, OHV representatives and the Vermillion Chapter of the Historical Society that is promoting the grant. Jean asked an invitation to Jeff Whilden, Don Jones, Terry Carwile and any other stakeholders be extended to attend the presentation .

Richard motioned to ask Vermillion Chapter of the Historical Society and BLM to provide a presentation to LUB regarding the proposed Sand Wash study. Jean added a friendly amendment to invite the City, Chamber and Tourism Association to the special meeting. Richard agreed to amendment and motion passed unanimously. Dave seconded. Unanimous.


Water:
Jeff provided an update on the Shell water right and that the County hired Holesinger Law to file the Statement of Opposition as per the LUB suggestion. It was noted the Statement of Opposition does not mean Moffat County opposes the filing. Tom commented on the lack of standing by many opponents, including Parker. Next steps are to begin the water referee discussions with opposors.


Road Maintenance Policy and Permit:

Jeff described the 4 meetings of the LUB Road Maintenance Committee and discussed the process to arrive at the existing policy and permit in front of the LUB tonight.

Jeff highlighted the Draft Policy and Permit paragraph by paragraph. The LUB discussed the policy and who would be responsible for maintenance and associated costs of maintenance. Ed wanted to make sure the policy added language to clarify that it was not the County’s intent spend money on maintenance but that costs associated with maintenance would be born by the applicant. Ed also clarified the maintenance permit would not allow upgrades or improvements, only maintenance of existing conditions. Tom clarified that the County is not responsible or required to bear maintenance costs, so the applicant must bear any costs associated with maintenance. Jean cited an example on her allotment where they would have been glad to repair a ditch crossing at their expense and found it difficult to get approval through the BLM red tape and felt the maintenance permit would be a good solution to similar issues. Ed motioned to forward the draft policy and permit to the Commissioners with language in both policy and permit that would assure the applicant bears costs associated with maintenance. Richard seconded the motion.

Other Updates:

Jean noted another wolf came into Colorado. She also noted that Ken Salazar endorsed removing ESA status on the Grey Wolf.

Jean asked about white talked prairie dogs. Jeff reported on the DOW update at Club 20.

Jean asked if anyone else would be interested in serving on the State Habitat Stamp committee as she was stepping down due to a busy life.

Tom reported a discussion with Tom Remmington where he believed the DOW was interested in owning more land where they can acquire it as the DOW was getting pressure from sportsman for fee title ownership vs. leases or easements.
