General Discussion/Committee Reports

Road Closures

Tom Gray explained the Commissioners have recently had three different road closure issues to address. Tom described the case of 99n where a landowner requested a closure, but surrounding landowners that were not notified of the closure protested it and the Commissioner ultimately decided to keep it open, but not until the proponent had spent significant dollars on an attorney to establish access for those he thought needed it. Tom explained if a policy existed that described the general conditions the Commissioners would be unlikely to review an abandonment request, it may have saved this landowner attorney money. Tom further described a situation on CR 47 where a landowner was locking a county road, and another situation on CR 93 where a temporary closure was requested. These combined issues highlighted the need for the County to establish a basic set of criteria for closing or vacating county roads.

The LUB discussed several general philosophies about when roads should be vacated and when they should remain open. Board members also discussed experiences they had regarding the CR 47 incident.

Doug asked how much money the county received in HUTF funds. Gray said it averaged $600 per mile of road. Doug advised not to make a policy because analysis should occur case-by-case and eventually you would just find an exception to your policy and have to revoke some part of the policy. Burt stated the policy needed to allow for case by case situations, but that there was a need for such policy, so as to give general guidance to the Commissioners.

Tom assured the group the policy would not be proactive in a way to additionally burden the County, but rather be a guidance document.

Burt said that he thinks that if a road connects two existing county roads it should never be vacated.

Possible Guidelines for county road vacation strategies could include:
cr to cr connections, public access to public lands, notify affected landowners over a longer period of time. The group agreed that public notice was the biggest dilemma and that a draft policy should be created. Tom suggested the policy be out there for review, a couple weeks before the next board meeting.

The LUB discussed the temporary closure of CR 93 and there was much discussion about closing the road to local traffic only, especially during hunting seasons. The LUB agreed with Tom’s proposal of having a temporary closure that allowed local traffic only to use the road. Much discussion occurred about what local traffic was. It was agreed that local traffic applied to local use of the land, rather than restricting access to residency.

Updates:

Basin Roundtable:

Tom updated the LUB on the nonconsumptive meeting of the basin roundtable. The roundtable adopted main channels as having nonconsumptive values and would be based on streams that have the ability to contribute to an interbasin compact agreement. Spending time identifying nonconsumptive values on tributaries that interbasin transfers could not occur, would be a waste of time. The next step is to begin quantifying the amount of water needed for the non consumptive values, a task that provides great nervousness for the board. Riparian habitat, rafting boating, recreation, instream flows are examples of nonconsumptive uses. Tom is concerned that it is possible that non consumptive uses are going to get a water right.

Road Maintenance BLM:

Jean, Ed, Richard, Steve, and Jeremy are the committee members assigned to finalizing the submittal to BLM on RMA. Jeff asked the group to meet now that the GIS work is completed for identifying the roads. The group suggested the week of August 24th.
