MOFFAT COUNTY LAND USE BOARD MEETING MINUTES December 14, 2009 Attendees: Dave Watson, LUB Bob Grubb, LUB Tom Gray, Moffat County Commissioner Jeff Comstock, Moffat County Natural Resources Dept. Call to Order: Meeting was not called to order. No quorum. Approval of Minutes from last meeting No quorum. General Discussion Basin Roundtable - Tom discussed that the basin roundtable would approve the Scope-of-Work for the Non-consumptive Water Needs Assessment after it had been adjusted for content. Major changes included clarifying that assessments would occur within stream channels and not flood planes and an in-progress review committee would meet and review the document during development. Yampa Doctrine is a document by Tom Sharp that discusses how water would be distributed in the event of a lower basin compact call. It asserts that the Yampa River is responsible for 500,000 af at the Maybell Guage. Public Education Initiative. Community Ag Alliance from Steamboat will host four sessions open to the public educating people about the roundtable process. The first session will be water 101. Pending legislation-Pace Legislation will focus on mitigating trans basin diversions. Kathleen Curry will likely host a landowner protection bill aimed at water structures, and she may host a bill regarding rafting. Tom discussed a philosophical concern about whether or not nonconsumptive uses are fully beneficial uses despite having legal standing. Water rights such as RISD’s and instream flows are nonconsumptive beneficial uses. Dave asked if there were instream flows proposed in Moffat County in 2010. Nothing this year has been identified. Bob asked about the non-consumptive study and if it included green vegetation in the banks and if it included marshlands around the river. Tom clarified this was not a land use use issue, and therefore the study should only stay within the streambanks. Jeff updated the group that the DOW P.Dog Plan is sitting on the Directors desk waiting for signature. He also stated that annual reviews are supposed to occur to keep the operating plan flexible.
